About Me

Gary H. Miller is a Martindale-Hubbell AV peer rated lawyer with 31 years of experience. He offers large firm expertise at small town rates to clients with interests in North Carolina and/or Louisiana.

Principally a transactional lawyer, Mr. Miller has counseled, advised and represented individuals and organizations, both privately-held and publically-traded, in connection with a variety of matters, including, but not limited to: the sale, purchase and/or financing of residential properties, both principal residences and “second homes”; the development, financing, operation, lease, management, sale and purchase of marina developments, refineries, manufacturing facilities, motels, hotels, a land-based casino, riverboat casinos, office buildings and other residential, commercial and industrial properties; asset (real and/or personal property) based financings; the formation, operation and dissolution of corporations, partnerships and limited liability companies; the preparation and negotiation of entertainment industry contracts; the protection and registration of intellectual properties subject to copyright, trademark and trade secret (but excluding patent) laws; the sale or purchase, or the operation and regulation, of ongoing businesses; the preparation, negotiation and implementation of contracts in general; zoning and historic use regulations and land use matters generally; and, wills and estates.

Mr. Miller also typically accepts a limited number of civil litigation matters to handle each year; principally, cases that are real estate or transaction related. For example, Mr. Miller represented the Dillsboro Inn and its owners in their very public dispute with Duke Energy over the removal of the Dillsboro Dam on the Tuckaseegee River in Dillsboro, North Carolina.

Mr. Miller graduated magna cum laude from New England College in May of 1979 and cum laude from Tulane University School of Law in May of 1982. Following his graduation from law school, he joined the New Orleans office of Jones, Walker, Waechter, Poitevent, Carrere and Denegre LLP, one of the largest law firms in the South – See, www.joneswalker.com. He was a member of that firm’s General Business Section for close to 20 years. In February of 2002, at the behest of a legal headhunter, Mr. Miller left Jones, Walker to join a smaller firm, the Lugenbuhl, Wheaton, Peck, Rankin and Hubbard P.C. law firm, in New Orleans. He practiced with Lugenbuhl, Wheaton until September of 2005, when he and his family relocated to Western North Carolina following Hurricane Katrina.

After he was admitted to the North Carolina State Bar during the summer of 2006, Mr. Miller opened a law office in Bryson City, North Carolina, the county seat for Swain County, North Carolina. In September of 2012, he relocated his principal office to Sylva, North Carolina, the county seat for Jackson County, North Carolina. The move to Sylva physically positions the office to serve clients from a larger geographic area, given Sylva’s centralized location in Western North Carolina.
