You should absolutely hire an attorney to try and improve your situation. There are some judges that will actually impose jail time at that speed. Those are not just traffic infractions, they are misdemeanor criminal offenses.

  • Will an unpaid open container ticket keep me from getting license back in north Carolina?

Just paid off two old tickets one feel, and one speeding ticket to try to get license back. Still have an old open container ticket that I haven't paid yet and was wondering if this will stop me from getting license.

Yes. It is a moving violation and if you have missed a court date, it will keep you from reinstating your license. Contact a lawyer, because in certain instances, it can also revoke your license for a year.

i went to court and i got a year supervised probation. I was released from my probation early and have paid all my fines and court costs.

    Dennis’s Answer

There is no such crime as a misdemeanor burglary in N.C. Whether you can have any crime expunged from your record depends upon a number of factors. How old were you on the date of conviction? Did the prosecutor defer prosecution? Accurate information is needed to fully answer your question.

  • How long does it take state charges to be dismissed after someone has been federally indicted?

My brother has been federally indicted. He as been told his state charges will be dismissed, but he is still sitting in jail waiting.

    Dennis’s Answer

The amount of time it takes for the state to dismiss charges after someone is indicted in federal court is entirely up to the state prosecutor. They actually don't have to dismiss at all since they are two different sovereign entities. Double Jeopardy does not apply in this situation.

    Dennis’s Answer

In most jurisdictions the District Attorney will want to see that you got your license before they will consider dismissing a No Operator's License ticket. You can always ask for a public defender again at your next court date, but are unlikely to get one. Explain your circumstances to the DA and you may get some help.
