    I agree. How long has it been since he has returned your call? Injury cases have many complicating factors which can delay settlement or negotiations. The best thing to do is make an appointment. Its never a good thing for a lawyer to avoid calls from a client but I am not sure your expectations are in line with reality. You guys need to get on the same page.     The answer to your question is complicated. If he is the biological father, he will have parental rights unless they are terminated. If he is not on the birth certificate, and there has been no legitimation or affidavit of parentage entered, then his paternity would need to be established. The fact that he was in prison will not automatically eliminate his parental rights I'm afraid.     Yes, you could conceivably sue the mistress for alienation of affection and criminal conversation. These are lawsuits that are available in North Carolina against a thirdy party that intefere with your marriage by destroying the love and affection or by simply having sexual relations with your spouse.     If they were dumb enough to friend you without knowing who they were friending then it's their own fault. If the photos are from their own Facebook site and are real then you should not have a problem. You will need to authenticate them in court. If they deny the validity of the posts and photos you may have a problem, but you should be able to get them into evidence unless they have an attorney and you are unrepresented.     Wow. Lots of confusion. You will need to consult with a divorce attorney asap. Even if you cannot hire one to represent you fully, bring all of your court documents and have the attorney review it with you. You cannot be placed in jail for contempt of court outside of a hearing unless there is an order in which you violated.     The crime of fornication is still on the books in North Carolina but it has been gutted by recent court decisions. What that means is that it has been essentially declared null and void by court interpretations of other higher court decisions due to the law being unconstitional.     Yes, you can call the police to return the juvenile. The 18 year old cannot be charged with kidnapping in my opinion, but can be charged with contributing to the delinquency of a minor depending on the facts. Did they cross state lines? Did they do anything else wrong? Where did they stay.

    I agree with my Minnette. Try and handle any potential move before you do it. Moving with a child is difficult, however if were put before a Judge it is often allowed if one parent needs for serious career advancement and the new location will add to the child's quality of life. Much consideration will be given to the parent remaining behind, the court had broad discretion to divide costs and the aggravation of travel to ensure reasonable custodial time with each parent.

    I agree with the above answers. The fact that you are living with your grandparents (which could actually be good bad, or indifferent) will have more of an impact on your custody case than your affair. That being said, exposing the children to a new love interest, or an inappropriate love interest can have some negative consequences so be careful with that.
