My DUI defense was based on 'Reasonable Suspicion'.
Tim told me we had a good chance to win - and we did. Thanks to the way Tim handled my case, it was a 'Slam Dunk' for the defense when we went to trial. He did his homework and it showed. He knew every detail about my DUI stop that night. One thing that especially stood out to me was his passion for my defense while in front of the Judge. I knew I was in good hands. Even with his many years of experience in DUI cases, he still put in a spirited defense on my behalf. No question in my mind, he is the best. And he proved it to me.

Mr. Vanderweert and his staff are wonderful. As i was charged with a DWI after coming home from a concert at Red Hat in Raleigh, I contacted his office and a number of other DWI attorneys as well. What set him apart from the others, and what ultimately made me choose him versus a number of others was the attention they gave to me right from my first call to their office. His paralegal Donna was incredibly helpful and helped me to understand the process I would be going thorough, and Mr. Vanderweert spent about 45 minutes on the phone with me on my initial call, even before I had decided to hire him. He listened to me, answered my questions and was very knowledgable and helpful. I felt much better after I had talked to him. He was very upfront about what he could and could not do, and he made me no promises other than that my case would have his full attention.
I decided to hire him because he assured me that it would be him, and not a junior member of his office, that would defend me from beginning to end. I talked to other attorneys who sounded great and who had great credentials but who, once I asked, admitted that they would not be actually representing me but rather a much less experience member of their staff. This happened to be the case for 2 or 3 other attorneys I talked to. Mr. Vanderweert assured me that he was the only attorney in his office and that DWI was really all he did, and he had been doing it for many years. I could tell from talking to him that that was true, and I found it refreshing that at one point i asked him about a certain issue and he said "I don't know but I'll find out" which led me to feel like he didn't need to brag or lie about what he knew to impress me.
after I hired him, Donna, his paralegal, was incredibly nice and helpful with every question I had. She knew who I was when I called and she remembered my specific situation and circumstances each time i called. She helped me set up a substance assessment and was generally there to assist in anything I needed. Mr. Vanderweert also met with me two different times upon my request and never rushed me or made me feel like he was too busy.
While it took awhile for my case to be heard, it was ultimately dismissed by Judge Worley or found that the policewoman who stopped me did not have a legal reason to stop me. Mr. Vanderweert did an outstanding job of cross-examining the officer and proving to the court that she decided to stop me on nothing more than a hunch that I might be driving drunk.
I am extremely grateful to Tim and Donna. They truly saved my life, as being found guilty of DWI would have created all kinds of difficulties for me as a graduate student and for my future employment. I have a friend who went through the same process some time ago with another DWI attorney and my experience was so much better than hers. Thank you so much!
Tim is a fantastic lawyer! He clearly knows the ropes and has a ton of experience with all the courtrooms and judges in the area, so he knows exactly what will and will not fly depending on the circumstances. Not sure how to put into words just how amazing I think this man is!!! I was charged with Careless and Reckless while driving my motorcycle. Mr. Vanderweert was incredibly personable, knowledgeable and confident. He handled my case quickly and efficiently. Mr. Vanderweert took my case to trial and had all of the charges dismissed. I honestly did not think that was possible as I had previously consulted several other traffic lawyers who basically said they could do nothing to help me. If you are looking for a lawyer that has the ability to think outside the box, be straightforward, honest and work hard for you, then this is the man. Tim Vanderweert is a brilliant lawyer. I was arrested for DUI in North Carolina after being stopped randomly at a DUI road block on the way home from dinner with some friends. I felt really disappointed in myself. The first wonderful thing that Mr. Vanderweet did for me was to answer the phone personally when I called his office on a weekend. He did not hesitate to give me legal counsel and a friendly and much welcomed reminder that I was just a regular person capable of making mistakes. He provided kind reassurance and also expert legal advise. This was all in advance of me formally seeking his counsel. He was so friendly and knowledgeable right from the get go. He took a deep look into the circumstances of my case. He is truly an expert in DWI law and you can see that other lawyers respect his thoughts and practice patterns. He was willing to take on a medical argument that ultimately helped me get my case overturned - resulting in a not guilty verdict. He had a very reasonable up front cost that he more than covered with his generous work hours. I have a pretty busy job and he made it possible for me to miss as little work/day to day life as possible while dealing with this. He took care of all of the back-end things. He was very honest and straightforward. He devised an excellent legal plan and did an amazing job of interrogating witnesses, including the arresting officer. I can't thank him enough for how much he helped me and I would recommend him to anyone in the Raleigh/Durham/Chapel Hill area who finds themselves in the unfortunate spot of facing a DUI/DWI. I'll be brief and specific. Hire Tim! If you are ever pulled for a DUI/DWI in the Raleigh/Durham (Chapel Hill) area.
He really is the best attorney I've seen and after spending hours in court watching case after case after case waiting for my own trial, I have seen my fair share.
First off, Tim was very honest with me about the prospects of my case. I'd had a previous DUI conviction and he never tried to convince me that there weren't risks to getting another within the 7 year probation period. Still, he believed we could win based on a number of factors that could offer a reasonable doubt.
I should say that I blew a .08 (twice) and that the breathalyzer did a check that registered a .08 as well, a very rare .08/.08/.08 combination (as Tim informed me).
Here is where his expertise really showed. He did a wonderful job during my trial of not only getting the officer to admit that there was some wiggle room with the instrument's readings, but also of explaining the nuances of this faulty gauge in the closing statement to the judge. Because of the nature of trial law in North Carolina, Tim did a great job of advising me NOT to take the stand during my trial.
Because I'm a highly intelligent and articulate PhD student, we both originally felt that I would make an excellent and compelling witness. Once Tim saw that the District Attorney had pulled up my driving record and could enter the information about my previous conviction (and a pending conviction in another county) into the record through the State's cross examination, he wisely advised me not to take the stand.
At every stage of the trial Tim seemed to be one step ahead of the D.A.. By the end of the trial, the D.A. seemed confounded. And after the judge rendered a NOT GUILTY judgement, the D.A. even tried to convince the judge to elevate the nature of my speeding charge based on previous DUI convictions. Too late!
Tim did a wonderful job and I recommend him to anyone seeking a fair and honest assessment of their chances of fighting a DUI conviction. I wish I had him during my first trial.
Also, just as a side note, Donna (his office manager) is also extremely helpful. She always called and emailed to keep me aware of changing court dates and times, as well as worked with me to make all my payments in a timely manner (but was very understanding about late payments and was never pushy about lower than previously agreed upon amounts).
In the end, I just want to say, do yourself a HUGE favor and hire Tim, especially considering he will do a consultation with you FREE OF CHARGE. Free legal advice just to help you navigate the legal process.
I forget to mention, my first interaction with him came during my first appearance in court. Tim literally walked me through the process of both getting a continuation of my case AND getting my license temporarily reinstated all while talking to me over my cellphone for the first time.

First, a big THANK YOU to Tim and his office (Donna his paralegal is amazing!) for helping me through an incredibly stressful time. They were always there to talk to and to answer my questions. I hired Tim to try a DWI that I has been found guilty of in District Court and bring it to Superior Court to be heard by a jury (in District Court the Judge hears your case, no jury). I had used the services of another law office for my District Court case and therefore have some ability to to compare them to Tim. I found Tim to be much more open and creative in the way he looked at my defense and willing to ask hard questions of the arresting officer. I definitely felt like he was on my side 100% and not pulling punches so he could maintain good relations with the cops or the DA. He did an excellent job for me and I would recommend him without reservation as an excellent and skilled DWI defender. Five Stars!
I'm a motorcycle mechanic. Tim was one of my customers. I hired another "Five Star" attorney to represent me on a DUI in district court. They pled me guilty. It so happened that Tim brought his motorcycle to my business the day after, and I spoke to him about my case. He took my appeal on FOR NOTHING as a favor to me and HE WON! I was found NOT GUILTY! I love this guy.
From the start to the finish of a very serious DWI case, Mr. Vanderweert was not only obviously very knowledgeable about the law and the intangibles regarding judges, he conscientiously kept me informed and provided realistic expectations of possible outcomes and consequences. We talked about the case in depth and he helped me to make a well-informed decision regarding appeal. He ultimately won a jury trial! I can, however, honestly say that regardless of how the case ended, I would have been very satisfied with the level of representation he provided. Furthermore, his demeanor and attitude made me feel more like a friend than just another number in a long list of clients. Exceptional attorney!
Charged with a DWI in Fuquay. I was driving home, minding my own business, driving fine, when stopped for "weaving." Once stopped, I was charged with DWI because I did poorly on the officer's tests, Hired Mr. Vanderweert, partly because I was thankful for the amount of time he spent on the phone with me explaining my options and giving me advice without having yet hired him.
I'm extremely happy with the outcome because the case was dismissed by the Judge after seeing that the officer had no right to stop me in the first place. Mr. Vanderweert requested a copy of the police video of the stop and showed it to the Judge. He argued, successfully, that I was not weaving enough to allow the police to stop me.
Obviously, I'm very pleased that I was not found guilty. I think this is due, in large part, to having a lawyer who took the time to understand my case and had the intelligence and patience to defend me properly. Tim is a nice guy, easy to talk to, but he can really be tough in court.
As for his fees, he's not the cheapest but not the most expensive. His fee was very reasonable given the time and effort involved.
His office support staff was exceptional. Always available, pleasant, helpful.
All in all, very postive experience and highly recommended to others charged with DWI.
