    Plaintiff's house burned which was clearly arson. Def. wanted Mize to agree to a polygraph and only agreed to pay if she passed it. Plaintiff never took it. Suit filed for willful independent tort for breach of contract. This case made new law in Virginia.

    Description:
    Va. Supreme Court provided under-insurance coverage for Plaintiff under school bus policy. Federal Judge in W.D. Va had ruled no coverage in prior case, which 4th Circuit transfered to Va Supreme Court. Va Supreme Held No Coverage just 2 years earlier. My case convinced the Va. Supreme Court to reverse it's earlier decision.

    Martin was injured while inside customer loading area when 3rd party hit gas rather than brake and injured Martin. Sears argued that Martin wasn't at greater risk than general public in the area, who were always present, therefor his injury didn't "arise out of his employment". Duputy Commissioner, then full Worker's Comp. Commission found for Martin. Sears appealed to Court of Appeals who affirmed for Martin.Charles Aaron was representing Martin in 3rd party liability suit.
