    I would suggest you ask a Virginia estate planning attorney about the differences between wills and trusts. Wills must be probated, but assets in a trust are not probated. Plus, trusts allow people to keep their distributions private, whereas a will is public (because probate is public).

    I'm going to assume you are aware of your need to be at court for your court date. But as for moving and coming back... 1. the obvious: check your bond terms and court papers 2. call your attorney. you need to hire an attorney sooner rather than later. I'm sure your local defense counsel would be willing to answer your question and help you in even more ways as the date comes near.

    While it is good that you have taken the initiative to attend AA and this is a first DWI, it is impossible for any lawyer to positively tell you what a judge may or may not do. I think you would be best served by hiring counsel to explain the situation. The chances the judge imposes the FULL sentence may not be extraordinarily likely, but again, it is a possibility. You also may have a suspended fine that you will now have to pay. Please speak to an attorney. Best of luck.

    In Virginia, any "intoxicant" can result in a DWI. As the other attorneys pointed out, even legally prescribed medications. One relevant question may be, how long have you been taking this medication? Don't answer here, but find a lawyer and explain everything.     Although your breath test resulted in a "deficient sample" reading, the officer arrested you because he or she either did have, or thought they had probable cause to believe you were driving while intoxicated.     Well, how you go about an appeal depends on the court where the original case was heard. If it was a misdemeanor in district court, then you can appeal within 10 days to the circuit court. This allows you to have a new trial. If you waited too long, you could ask a lawyer to help you with a motion to reopen, but it is better in most cases to pursue the appeal, if possible.     You should talk to an attorney right away. The police must have probable cause to arrest a person for suspicion of DWI. It seems as if you are already aware that a 2nd DWI in 5 yrs is more serious than a first DWI. See my attached link for much more Virginia DWI information / laws / penalties.
