Payne & Bond v. State

Bennett James Wills

Case Conclusion Date:February 27, 2013

Practice Area:Appeals

Outcome:Reversed and Remanded for New Trial

Description:Drafted petition for Petitioner J. Bond. Petitioners were convicted of first-degree felony murder, kidnapping and use of a handgun in the commission of a felony. Trial court reversed and remanded the convictions because the Circuit Court abused its discretion by permitting testimony about cellular tower site location without qualifying the State’s witness as an expert and that the error is not harmless beyond a reasonable doubt. The convictions were overturned and the case reversed and remanded for a new trial.
