Chances are you were charged with 3802(a)(1) which is basically the general impairment section as well as the section that would apply to what your blood alcohol level was.     First you want to make sure your husband talks with and hires a qualified DUI attorney in this County. Many times when an individual is charged the criminal complaint (which you are looking at) will state DUI--1st Offense even if the person had priors. The Judge really isn't changing anything but eventually the District Attorney's Offense will get the file, pull the criminal history and driving abstract to make a proper determination. There is a look back period in Pennsylvania as well so this is just one of the things your husband will want to discuss with an attorney.     Hire a Montgomery county attorney that handles traffic matters. You should enter a plea of not guilty he and request a hearing. He qualified attorney should be able to put you in a much better position than you are right now including potentially reduction in points and fines. From what you describe you will be charged with a DUI and possibly some other minor traffic vilation. It sounds like this is your first offesne so you should be eligible for the ARD program. This is a first time offender program that diverts your case out of the criminal system and allows you to eventually have your criminal record expunged.
