  • Trial Question

I was found guilty of disorderly conduct in abstencia b/c I had to work. Is there a way that I can see the minutes or what was said at the hearing?

    Theodore’s Answer

My esteemed colleagues are spot on. Even if there was testimony, there would be no stenographic record.
Make contact with an attorney who specializes in criminal defense. (Avvo would be a good place to look.)

  • I was sent a citation for retail theft on 6/23 but the crime was said to happen on 4/06. do I plead guilty or not guilty

I was not stopped in the store for retail theft. I have been in the store and I was stopped at another branch of the store for theft but I was just told to leave. The amount of the merchandise said to be stolen is 40.98. What will be on my record ...

    Theodore’s Answer

PLEAD NOT GUILTY! Contact an experienced criminal defense lawyer immediately. A conviction for a charge like retail theft can follow you for a long time, effecting your ability to get a job, be licensed professionally, insurance and credit, to name a few. Do not try to handle this yourself.

You husband needs to contact an experienced local criminal defense lawyer asap. Jail is always a possibility in a criminal case but without speaking with your husband, no one can answer your question.

Contact your attorney and most important talk to your PO. Montgomery County probation officers are generally agreeable to reasonable requests if they are able to do so.

The short answer is "Yes" with the facts as presented. If you cannot afford a lawyer, you may qualify for a public defender. But you might try talking to an attorney on Avvo. Most of us offer a free consultation.

  • Spoke to 3 lawyers on avvo . My question was not answered . Please give me Criminal lawyers .

Proof of claim was for $38,000 but additional $11,600 was due to fraud , misrepresentation, dishonesty of debtor .Local Police will not file theft report . No Avvo lawyer has really answered question .l need opinion of criminal lawyer.

    Theodore’s Answer

With all due respect, you have not provided any facts to support your "proof of claim..... additional.... due to fraud..." to allow any determination of criminal activity. Unless you can provide the facts to support fraud or theft charges, no one can help you. However, if the local police won't file criminal charges, you have the option to go to the District Attorney's Office and try to file a private criminal complaint.

    Theodore’s Answer

My colleagues are right on the money with their advice. Talk to your Dad. Then you and you Dad call a lawyer who is familiar with the local court and the police. ( I will assume that the "Target" is in Montgomery County.) DO NOT just plead guilty if you get served with a citation.
