Montgomery County Intermediate Unit No. 23 v. C.M., No. 2012 cv-1608 (E.D. Pa)

Case Conclusion Date: 01.03.2012

Practice Area: Education

Outcome: Favorable administrative decision, partial appeal and couterclaims pending.

Description: In this case, attorney Stanczak represented a three year old child with Autism and his mother in their claim that the Montgomery County Intermediate Unit 23 (MCIU) failed to adequately evaluate the student, failed to address established needs, including the child’s need for feeding therapy, and failed to timely provide an appropriate IEP for the student. The Hearing Officer awarded substantial compensatory educational services to the child and ordered the MCIU to pay for an independent educational evaluation and to take immediate steps to address the deficiencies in the child’s IEP. The IU’s partial appeal of the decision and the counterclaim filed on behalf of the mother and child are pending in the U.S. District Court for the Eastern District of Pennsylvania.
