    To determine the marital portion of his retirement you should hire an actuary. You will need a special court order called a QDRO. You cannot collect your portion until he retires. Alimony is separate from division of his pension. In both cases, you must pursue claims against his retirement and for alimony prior to finalizing the divorce.

    If you are not represented then you can call his attorney. However, it would probably be more effective to go through Domestic Relations.

    Anyone can potentially win custody for just about any reason. You will need to file a custody complaint if you don't currently have a custody order or a petition to modify custody in the event you do have an order. Her having an affair with this person will not be relevant to custody, but if he has convictions that are violent or show a pattern of alcohol or drug addiction, you would have a basis to have him evaluated to determine if he poses any threat to the children. The result of the evaulation would then be relevant to the custody case.

    The divorce complaint may be filed in either Cumberland or Dauphin County so choose the county which would be most advantageous for your position.

    If you believe his behavior is in violation of what the order says, then you can file a petition for contempt to try to enforce the order. If the order needs additional language to address the sleeping situation and administration of prescription medication, then you should file a petition to modify the order.

    If the father is in violation of a custody order then your girlfriend will need to file a petition for contempt in the county in which the order was issued. If she wants to try to get custody, she will need to file a petition to modify the custody order.

    Ask for a provision to be included in the order that the child's step-father have no contqact with the child until he obtains a 5329 evaluation.

    You may be able to fight spousal support but if one of you files a divorce complaint he can then seek APL which is calculated the same way (40% of the difference between your net incomes). The sooner you get it started the sooner it will get done. If you have no kids together you can cut off all communication with him and stop paying anything on his behalf. If he doesn't like it he can file what he can. If you make more money than him and he is awarded either spousal supporrt or APL the duration will only be during the pendency of the divorce proceedings. The marriage sounds as though it was too short for him to qualify for any meaningful APL. There is no requirement that you ever hav eany communication with him as all divorce related communication can be handled by your attorney.

    If you moved to York after the kids were moved to York then York properly heard the case. If you did not want the case to be in York you should have filed a preliminary objection when the case was originally filed there - you typcially cannot wait until after the decision and then seek a venue transfer.
