    Although you can sue, it is important to be aware that many agencies have some form of immunity under statute or the case law. The applicable state law would need to be examined to see whether immunity exists and, if so, whether there are any exceptions to immunity. I suggest meeting with an attorney in your state familiar with this area of the law to evaluate the possibility of a claim.
