  • At what point is it permissable to ask for early removal of probation? Who would I ask?

    DUI-1st Offense. RX..All requirements satisfied, Community Service, Lisc suspension, A & L Counseling..All fines and costs have been paid.

    Good Morning, I'm assuming you took the ARD program for your first time DUI?

    Although every county in Pennsylvania may be a little bit different when it comes to the procedure for filing/requesting a Petition for early termination of ARD probation, as long as you've served some of your permission to have all of your requirements completed in proof of everything I'm sure it's possible to at least request it or file a petition. some counties require you to serve at least half of your probation period / or 6 months before considering granting your request. Speak to your probation officer and/or contact an attorney with in the county that the offense occurred to find out the details.

    Under what circumstances would a lawyer ever tell the client to admit guilt and cooperate with the government? I know a sentence is up to the judge. How can someone trust the government will make a good recommendation for cooperation?

    To answer this question, numerous factors would need considered...the facts of the case, & allegations against the person., existing evidence , witnesses, prior record score, and what is being offered in exchange for cooperation. An attorney can make recommendations to his or her client but ultimately it's the client who decides which route is best for them. If you're in a situation like what you described, you can always choose to interview multiple attorneys to find the right one for you.

    It is difficult to answer your question completely based on the information you have provided. There may be certain defenses in your case that an experienced Attorney would be able to identify but more information would be needed. You may want to schedule a consultation with a local Attorney and have them review your case. After they have discussed the case with you and reviewed your Criminal Complaint along with the Affidavit of Probable Cause, they should be able to tell you what possible defenses there are in your case.

    Contact a local Attorney immediately, especially since court is tomorrow! It sounds like you are ready to fight for what you feel is right, so it's time to get an Attorney! It's sometimes confusing when you have so much going on and are asked to sign documents. Many people in this situation do not realize how signing a single document can cause so many problems for them in the future. Having an Attorney who is experienced in this area and will fight for your rights, will benefit you tremendously here.

    You should consult with a local Attorney before doing anything! Once you start to give statements and answer questions, the information you provide can not be taken back! Even though it may not seem like you have anything to worry about by meeting with the police, protect yourself against self-incrimination and at least speak to an Attorney before you make your final decision on how to proceed!

    Contact an Attorney ASAP to discuss your case. Do not discuss or post any facts of the case. These are very serious charges and you should not proceed without an Attorney!     To help protect your record, you should not defend yourself without at least consulting with an Attorney and finding out your options. Having worked with may individuals in situations like this who were first considering the option of proceeding without an Attorney, I can tell you that it will only benefit you to have one by your side throughout the process. It is possible that there are certain things that can be done to help protect your record and having an Attorney who knows what those things are, is key. Retain an Attorney and work with them to form a strategy -which actually may include some of the things you mentioned above.
