When do you think it would be needed to hire an expert witness for premises liability case (Trip and Fall)?

Asked by a user in New York, NY - 3 months ago.

The above answer is a good one. However sometimes the accident scene is subject to change, so one factor to consider in the risk/benefit analysis is whether the circumstances need to be preserved. Occasionally you can hire an expert to do a preliminary inspection, take photos, memorialize facts and measurements, at a reasonable inital cost, and then have that person on standby if later need arises. Best wishes, Bob Robert Brenna Jy

Can i file a wrongful death suit on behalf of my 2yr old grandson against a security guard company.

Asked by a user in San Pedro, CA - about 1 month ago.

I'm so sorry to hear of this tragedy. It would seem like this poor young boy is owed a great deal, and I realize that the system of justice can only do a small part in trying to make his life better after he suffers from such harm. I would urge you to either bring the suit yourself, or see to it that somebody is named as a representative of the father's estate but you must find out the appropriate steps in your jurisdiction to allow the lawsuit to be commenced. An attorney in California who is...

Can you help me with a legal question? I do believe I have been discriminated by Sunoco/APlus

Asked by a user in East Rochester, NY - about 1 month ago.

as opposed to contacting an attorney merely to sue, you should contact an attorney who is familiar with employment law. A simple consultation will likely take care of this. It sounds like it may be a difficult situation, but there is at least a chance that with the help of a good employment attorney you may be able to get the job. I do not feel like it would be a great likelihood of a successful outcome of any significance in a lawsuit. Best wishes, Bob Brenna Jr. Brenna Brenna & Boyce...

Can I Sue?

Asked by a user in New York, NY - about 1 month ago.

yes-and you should contact an attorney immediately. There are occasions when there are municipalities involved which are not obvious. It is always a good idea to contact a good personal injury attorney immediately after such a circumstance. If a municipality, governmental agency, or authority is involved, there may be very very strict timelines on filing an initial pleading which is called a "notice of claim"-or if it is against the state a "notice of intention to file claim." Even if there is...

Can personal injury case be moved to another court and can a judge throw out a jury verdict? If so why and how does it work?

Asked by a user in Lewis, NY - about 1 month ago.

moving the case to another court is problematic without there being any more specific fact pattern as to why the injured plaintiff cannot he get a fair trial in that venue. It is not impossible, but it is extremely unlikely. I assume this person has an attorney, and I assume that the best answer would come from that attorney. That having been said, if there is a jury verdict which is too small for the evidence proven at trial, in the words proven at trial are important words, then a judge...

Can my trust include ira funds?

Asked by a user in Plano, TX - 3 months ago.

ThisIs a very serious problem. Usually Transferring any type of retirement account including an IRA or 401(k) into a trust will trigger taxes and penalties by placing those funds into a trust as if you had broken the deferred tax vehicle yourself. . A good estate planning attorney may be able to help you formulate a plan that allows the trust to be the beneficiary upon your death, which may well accomplish your objectives, but avoid the adverse consequences I've described above. This is not...

I was in an accident. Car is in my name but the ins policy has both names on it. Can my wife be sued?

Asked by a user in Rochester, NY - about 1 month ago.

Your insurance company should be providing you with an attorney, without cost to you. You should immediately contact that attorney and ask this question in a private and relaxed setting. If in fact the title of the car does not have your wife's name on it, and your wife was not driving, then she should not be subject to having any personal financial losses arising out of this incident. Nonetheless, sometimes people are not aware of all the facts that they post in an informal forum such as this...

Life Insurance Beneficiary vs Will

Asked by a user in San Francisco, CA - 7 months ago.

The will only controls what passes through the Estate. If the beneficiary designation in the policy is valid- that controls. If surrendered- then there would be no beneficiary because the insurance is no longer in effect IF truly surrendered completely.. The guy who assaulted hasn't paid for the medical charges for my oral surgery. What shall I do? The case is closed now.

Asked by a user in New York, NY - 9 months ago.

You should file suit asap. Since he was prosecuted and you have a guilty verdict, it is called Res Judicata- meaning the thing has already been adjudicated. you are entitled to more than just your out of pocket expenses. Are you also know that section 213-b. of the civil practice law and rules in the State of New York usually allow the victim of a crime to commence an action for recovery of injuries which were resulting from the crime within seven years of crime, even though an intentional act...
