  • What do I do if cps tries taking my children?

My son's counselor has reported my husband with false alligations. How do I go about proving he's and my innocence

    Anthony’s Answer

The burden of proof is on the agency, however it feels like you have the burden because people in the system feel like you are at the court of a reason. First thing you must do is ignore the community and courthouse scuttlebutt. Then make sure you have a really good family lawyer who knows his or her way around abuse and neglect cases. They may ask you and your husband to participate in counseling programs. Go only with your lawyers permission. Also do not talk about the case with anyone other than your spouse or your lawyers. No one else needs to know anything. Keep visits with your child happy and friendly and of course do not discuss the case with him either. Keep the faith. You do what your lawyer tells you, it should work out just fine. Good luck.

  • Can someone be charge with a gun that the police officer took during a search without warrant?

My brother is charge with a gun that the police officer took from his house a year ago during a search without a warrant. Now a year later they raid his house again without a search warrant again and found no drugs or anything illegal but my broth...

    Anthony’s Answer

Yes they can. They may have a hard time getting the charge to stick however after a suppression hearing. Your brother should make sure he has a good lawyer who is up on his criminal procedure. Conferencing with a civil rights lawyer wouldn't hurt for the second part of the case (suing the cops for violating his rights.) Check out the AVVO attorney's in your home area. I will bet you find a good group of Criminal Defense lawyers on here. Look for lawyers who belong to the NCACDL or the NACDL or are active in (not just members of but leaders of )the State Bar. Ask if they have ever handled a suppression hearing to suppress the proceeds of a bad search. Look to see what the other lawyers say about their work. See if they have ever lectured in CLE classes on the topic or written articles published on the issue. Then look for someone with at least 5 years experience and better if they have more. Why? Because gun cases are harder than most and you want someone who's experience level is up to the work.

  • Do I need an attorney for proving my innocence in a PRE-paid credit card charges?

I work for FAVOR (delivery service) and was given a PRE-PAID ( PEX CARD). There are some charges on the PRE-PAID card that I did not make but I am being intimidated to pay --based on the only fact that the charges were made on the card I had in m...

    Anthony’s Answer

You should hire a criminal lawyer. There are a bunch of good ones right in Dallas. You need to protect yourself from both legal charges and the credit card charges. Fraud is a very serious crime and it would make finding another job nearly impossible. Run do not walk to a good criminal lawyer with experience in handling White Collar crime. Good luck.

    Anthony’s Answer

I mildly disagree. You have a eight to ab adversarial hearing on the document. Even if you consented you can appeal that you were not advised of the effects of the consent. Consent must be knowing and intelligent.

I plead guilty to dwai offense 1192.1.. 2011 was arrested 2010 i have other minor offenses (violations) 5 to be exact 3 seal and dismissed 2 which open container and fare invasion 02 and 09 am i protected under the consideration factor in article 23a

    Anthony’s Answer

Yes to an extent. Peace officers are quasi police officers and article 23 section 750 (5) specifically excludes police dept. from the statute.
Further even if you are eligible given the type of job you are seeking it could be color-ably claimed that these prior convictions could render you ineligible for the job you are seeking

    Anthony’s Answer

is there a question here? If you are asking if the five prior arrests are stopping them from hiring you, well no one arrest is probably doing that except for maybe the impaired however if being a driver is part of the job and if you will be driving their vehicle you might understand that the overall look is not a good one.
Can they not hire you? Not necessarily based on your arrests but if the have a similar or better candidate without this arrest record guess who gets the job.

my New Jersey license was suspended. my New York license is valid I have a car registered and insured and everything. get my privileges back in New Jersey I have to get a breathalyzer machine in my car. can you Jersey stop me from renewing my N...

    Anthony’s Answer

    Yes and no.
Jersey cannot suspend your NY License but it is supposed to tell NY if your license there is suspended and why. NY would normally suspend your license too. (It may have already happened.)
    1. Hire an attorney to grab the status of your NY License
2, Have him speak with driver's improvement in Albany to see what you can do in NY to keep your license.
    3. You may have similar restrictions in NY as in NJ but you may not so let the lawyer check into your specific information.

  • Is it illegal?

I was in a custody battle with my ex boyfriend. When a couple days after court was dont he told me that him and his family paid the judge $200 to keep my son from me.. Is that even legal? It was almost 2 years ago but i cant find a lawyer to help ...

    Anthony’s Answer

No it isn't legal and is very likely untrue, but you can report it to the local DA. More likely you cannot find a lawyer because you have a bad case and no money. In law, you often get what you pay for. If you want the best you need to find a way to afford the best. Legal fees are expensive but a good lawyer is worth his weight in gold.
