Attorney Pippen was correct in directing you to old tax returns. In addition, if the trust created by your grandfather for the benefit was of your mother was done as per instructions included in his last will and testament you should check with the surrogate's court of the county in which he resided. If a trust was created in this manner you would be able to find the letters of trusteeship granted to whomever was overseeing the trust.

Having a new charge added would be an oddity. If it is your desire to avoid points and fines you need to plead not guilty. Consult with an experienced traffic attorney who can negotiate with the prosecution or get the ticket dismissed outright.

As the other answers have already indicated, if you have an attorney already you should be consulting with them about these developments. You had indicated that the will has not yet been submitted to probate. If that is the case then the executrix has not been legally appointed. In addition as a distributee of your parent's estate you do have the right to object to the probate of the will which seems to have disinherited you. In order to be successful in objecting to the probate of a will...

As Mr. Lo Piccolo stated, the new regulations are designed to be very tough on repeat offenders. There are many who think the new regulations are too tough and that is the reason why they are expected to be challenged.

The terms of the will are what the executor needs to abide by. That being said, more information would be required in order to provide you with a more accurate answer. You did not indicate whether or not you are a minor, or if your father has any type of legal guardianship over you. I would advise that you meet with a estates attorney to discuss the particulars of your case.

I agree with Mr. Aminov. If the value of your father's estate is below the $30,000.00 threshold then in many cases an attorney may not be required. You would need to contact the Surrogate's Court of the county in which your father resided. They can direct you to the proper forms (small estate affidavit), and in some cases can assist you in properly filing out the required information. You can then be appointed as the legal representative for the estate and be authorized to take possession...

You have not jeopardized your ability to get an attorney by requesting an adjournment. However, I would recommend you contact an attorney familiar with TVB as soon as possible to talk about taking on your case. Matters in TVB are typically win or lose with no reduction of charges or plea bargaining. A good advocate in your corner can make all the difference. In addition, in April the way that traffic tickets in Suffolk County are handled will be changing dramatically. An attorney can...

As my colleagues have pointed out, most radar guns in use can measure speed of vehicles heading towards or away from the point of origin. If the ticket was issued in the Bronx I suggest you contact an attorney who is familiar with the Traffic Court (TVB) system.

As the other answers have indicated, having your mother meet with an attorney and submit a petition for letters of administration may force the deceased's son to show his hand and produce the will. However the issue is that by electing to proceed as though there is no will then your mother becomes bound by the rules of intestacy in New York. This would mean that as spouse she would be entitled to the first $50,000 of the estate and half the remainder with the rest being distributed to the...

The ticket you are facing is an 8 pt violation. When you have 6 or more points within 18 months on your license the NYS DMV will apply a Driver Safety Assessment. In this case it would be $450.00 broken into three yearly installments. This fee is over and above the fines and increased insurance premiums that may accompany this ticket.
