Husband's ex parte divorce and subsequent re-marriage invalidated.
Husband sued wife, seeking declaratory judgment that Mexican divorce, obtained over Internet, was valid. Parties moved and cross moved for summary judgment. The Supreme Court, Nassau County, Anthony J. Falanga, J., held that: (1) Mexican divorce was invalid; (2) doctrine of laches did not prevent wife from contesting divorce; and (3) wife was not judicially estopped from challenging decree.
