  • My friend has pleaded guilty to two counts of murder for 50 yrs, to life, Can he take back his plea and get his time reduced?

    He has two counts of first degree ... his plea was made under duress. And he had a court appointed lawyer that didn't wish to help him.

    I take it from your message that your friend has not yet been sentenced. There are different tracts to take prior to sentence and post-sentence. Prior to sentence he will either have to retain an attorney or ask the court for a new assigned attorney to make a motion to withdraw his appeal. There are limited grounds for withdrawal motions and a competent attorney can over those grounds. Additionally you do not make it clear why your friend took such a plea and whether it was on a murder 2nd degree or murder 1st degree charge. Background and facts will be important for any attorney to know so as to give your friend the best possible advice.

    PET/NP stands for Petition/Non-payment. I believe RESDT stands for Residential.

    You are at the very beginning of a very long road. Foreclosures can take several years in NY but you should have competent counsel representing you. In addition you should seek out a home affordable modification program through your loan servicing company.

    You have a number of issues here as relates to the child's father and as to your fiancee. Once you are married your fiancee who is then your husband can seek to adopt your daughter. You will have to seek the termination of parental rights against the biological father. Good luck.

    Your first step is to talk with your parents and family as to where you were born but it is not clear from this post that you are seeking to break the seal on an adoption or some other matter.

    You can always move in Family Court for a downward modification of child support based on income and so long as you are current on your support obligations.

    NYPD makes arrests and the decision to prosecute is in the hands of the local prosecutor and judge. You do not indicate you were brought before a judge or that you ever made it to central booking so an answer is not clear cut. You do have a civil option and can sue your exBF and take him to landlord tenant court.

  • How successful are appeals on Eviction decisions?Tenant was given a 3 year stay claiming she was an owner and lost that case.

    She lost eviction case and has 3 months to vacate, she is now appealing judge decision. Also, does a landlord have the right to a court appointed attorney for the appeal in New York?

    A landlord does not have a right to court appointed counsel for an appeal or even on the underlying landlord tenant matter. It does not seems likely that the tenant will win the appeal but more information would be necessary regarding the courts rulings.
