    Yes you can but it may be more costly. I would look into hiring a lawyer in Nassau or Suffolk county because they are likely more familiar with the judges in Suffolk county.

  2. I was arrested in april for a dwai for meds that Im legally prescribed. Its a felony charge. The blood has not come back yet.

    If your Wife is the Plaintiff, which it seems she is, you can not dictate to her what the grounds for divorce will be unless you agree to what the grounds will be. With respect to the new no-fault law in New York, that only applies to actions commenced after October 14th of 2010, so a motion to the Court would not help. Your wife would have to refile for divorce under a new index number and with the grounds of no-fault. You could purchase your own index number and serve her with papers under...

    I am sorry to hear about your situation and I can certainly help you. You can file an application with the court asking him to be ordered to maintain all of the bills, and in addition you likely have a basis to receive spousal support. The Court will not allow him to force you out of the home you live in with your children while the case is pending.
