    Lance’s Answer

I am not sure what you are stating "is not allowed", but a Court has the power grant 50/50 custody if they feel it is in the best interest of the child. I cannot state why the attorney for the child didn't "push for it to begin with", but the attorney for the child doesn't control the court decision. You should have an attorney to represent you in the case to ensure the issue is dealt with properly.

You will not have to pay back child support. First you will need to file a paternity petition. Once paternity is established you will be able to seek visitation rights and will be subject to an order for child support. Feel free to contact my office at 516-488-2255 to discuss your matter in further detail or contact another qualified attorney through AVVO.COM.

It sounds as if you would have a basis to obtain an order that allows you to care for the child. You should definitely hire an attorney to assist you. $5,000 is not unreasonable but you may be able to find an attorney for a little less.
