    You should consult with a divorce lawyer immediately so that you do not waive your rights. If your spouse receives a default divorce, then your spouse can receive the relief requested including legal fees.

    Child support may be modified due to a change in circumstances. If she has surgery and her income is reduced, then it may be modified based upon her earnings after surgery. You can bring her back to court when she recovers to seek an increase.

    If everyone agrees to a settlement, then it may be resolved in one court appearance. If there is an attorney to be appointed in the Bronx County for the child, then the case will be adjourned until the attorney has an opportunity to interview the child. You can anticipate an adjournment of 6 to 8 weeks based upon the current back up for the Children's Law Center (the attorney for the child) and the court's dockets.

    If your ex fails to pay child support, then you can file an enforcement proceeding to require him to pay the back payments. You should bring a copy of all the prior paperwork to an attorney to review and schedule an appointment for a consultation.

    Schedule an appointment with a divorce lawyer and bring along a copy of all the paperwork, especially the financial records and tax returns of both parties. Without real numbers it is hard to give advice.
