    You can go to the court house and go to the pro se clerk to get a booklet to explain the divorce process. It is best to obtain an attorney to assist you in preparing the numerous papers necessary for an uncontested divorce.

    Your spouse can also file papers in any county in NYS under CPLR 509, even though neither one lives there. It is best to hire an attorney to go forward with a divorce.

    Your lawyer needs to file paperwork for the judge to sign by the 8/18 date. It does not mean that the judge will sign the paperwork by then. Speak with your current lawyer to follow up and complete your case. You can not get married until your lawyer give you the paperwork (judgment of divorce) after the judge signs it and it is entered by the County Clerk which will be months after the judge signs it.

    Received papers to go to court. Spouse wants a divorce. I do not wish to contest it. It says I would be responsible for lawyer fees and divorce cost.

    You should consult with a divorce lawyer immediately so that you do not waive your rights. If your spouse receives a default divorce, then your spouse can receive the relief requested including legal fees.

    Child support may be modified due to a change in circumstances. If she has surgery and her income is reduced, then it may be modified based upon her earnings after surgery. You can bring her back to court when she recovers to seek an increase.
