  • My divorce is final, but me and my husband decided to give our marriage another try is there a way to take back to divorce?

We've only been divorce for about a month, during the process we decided to give it another chance and found out it was too late .

    Brian’s Answer

Once you're divorced, you're divorced. There is no taking it back.

I suggest taking the time to "date" each other before remarriage, just to make sure that this is what you both want. I doubt you want to go through another divorce.

  • If I fire my attorney do I have to start all over?

My attorney has been doing some (what I would consider) highly unethical things regarding my case. I do not want to deal with her but we are within 6 months to a resolution (it's been 2 years). If I fire her can I go to my ex's attorney and just a...

    Brian’s Answer

You are not required to keep the same representation throughout the duration of your action. You can fire your attorney, and become a pro-se litigant, or retain other counsel. While you may be ready for the case to end, remember that it is hard to modify an agreement/judgment if you decide you are unhappy with it down the road.

  • Can I make my own choice as to where I go?

My legal mother just told me that she's trying to reclaim me and make me move to Florida with her. When I appear in court is it the judges final decision as to what happens with me?

    Brian’s Answer

A judge has final say, however, your wishes will most likely be taken into consideration. An attorney may be appointed for you.

  • How can I file for divorce by myself and make it the "simplest form" and the quickest?

    Brian’s Answer

Check your county's supreme court website- they may have the documents online that you can print. Alternatively, you can get the documents if you go the courthouse.

I always recommend that parties looking for a "fast" divorce utilize the experience of a lawyer. An attorney's expertise will help guarantee that all documents are filed on time and in the correct manner. There is a good chance you will make a mistake, which may result in a delayed judgement.

    Brian’s Answer

As long as you are a NY resident, you can file here. Your husband will need to be served with a Summons overseas, which will require the assistance of a divorce attorney. The complexity of your case depends on whether or not your husband chooses to contest the divorce.
