  • Young motorist failed to stop at stop sign, totaled my vehicle. She has no license, only permit and no licensed driver in car.

Loss of work 7-10 days due to accident. Vehicle was used for landscaping business, insurance company offered rental car (not pick up truck to tow trailer of equipment). Can I sue her insured sister who owns the car for allowing the use of her car?...

    Eric’s Answer

Under New York law the owner of the car is liable for the negligence of anyone who drives the car with permission. Your no-fault coverage should pay for your medical bills and lost wages though. In order to sue the other driver/owner you need to show you suffered a "serious injury" as defined by the Insurance Law.

  • Do I need a fraud lawyer

I'm 34, when I was 25 my father forged my signature on my gerber life grow up plan and used my social security number without my permission to cash in on my plan without me knowing. is there anything I can do or has it been to long?

    Eric’s Answer

The statute of limitations for a criminal prosecution has expired. For a civil case, the statute of limitations is:
the greater of six years from the date the cause of action accrued or two years from the time the plaintiff or the person under whom the plaintiff claims discovered the fraud, or could with reasonable diligence have discovered it. claims discovered the fraud, or could with reasonable diligence have discovered it.

I am not sure that would apply to the life insurance company because it was not part of the fraud. Your only option may be to sue your father.
