Outcome: The client was put back into ownership of the home and the mortgage was reinstated.

Description: I recently handled a compelling foreclosure action in which a client’s home had been foreclosed by and deeded to the lender at sheriff sale and the client and family were being removed from the premises. Review of the matter indicated the client’s spouse was suffering from a disability and failed to disclose any aspect of the foreclosure to the client. The client only became aware of the matter at the time possession of the premises was being sought by the lender. I was able to reverse the foreclosure judgment and sale, as well as a subsequent tax sale foreclosure judgment avoiding the removal of the client and family from the premises.
