If you’re selling your home and moving out of state, stay away from Mr. Rittie. He believes in giving the state of New Jersey two percent of your sales proceeds, which in our case amounted to $9600, when there is NO requirement to do so. Technically, he supported the filing of a GIT/REP-1 form, which calls for withholding two percent of the proceeds, instead of a GIT/REP-3 form, which exempts people who are selling their principal residence from the withholding requirement. We lived in the house for 15 years, so we were clearly entitled to the exemption.
We could have – and should have – received the $9600 at the closing. Instead, Mr. Rittie believes it’s simply a “more conservative” approach to needlessly hand the money over to the state and then make us prove to the state that we’re entitled to get it back. We had to overcome the presumption he created that he wouldn’t have paid the $9600 to the state if we weren’t required to do so.
Luckily, we later discovered on our own that we were entitled to get the money back and the state eventually refunded our money. But we lost the opportunity to invest it where we would have earned over $3600 during the time the state held the money.
We asked to be compensated for this lost opportunity, but Mr. Rittie rejected that request. He believes that unnecessarily depriving clients of their rightful sales proceeds is the proper way to represent them because he somehow thinks doing so is the “more conservative” approach. With my daughter suffering from triple negative breast cancer, we desperately needed the money, and so we begged and pleaded with him, but Mr. Rittie coldly refused to the right thing.
I have worked with Mr. Ritte on three separate occasions. I have always found him to be all of the things listed above and more. He is extremely easy to talk to, and does not overload you with a lot of legal jargon. He has always been responsive to my calls, if not able to take my call, he gets back to me in a very reasonable and timely fashion. He has been extremely organized, making our recent closing as smooth and easy as I could ask for. Even though he has a pleasant manner about him, he stands his ground when the opposing attorney gets too assertive. His billing is clear and concise, and I feel his fee schedule has been very fair. I felt that I was charged very fairly, and not nickeled and dimed for every email or phone call. Something I find appalling by other attorneys I have worked with. I would highly recommend his services if you are looking for a very knowledgable, thorough attorney who has an easy manner about him.
