    My client was arrested in Teaneck following a concert. A fight apparently broke out and, in his attempt to help break it up, he was alleged to have shoved a security guard. He was charged with Simple Assault and Resisting Arrest. I appeared in court and, after demonstrating to the municipal prosecutor that my client had absolutely no prior involvement with the law (in fact, he was honorably discharged from the US military), that the "security guard" was dressed in all black (not in a police or other similar uniform) and approached my client from behind, and, most importantly, did not suffer any injuries, she agreed to dismiss the case in the interest of justice.

    My client was home on a Friday evening when police arrived, claiming that someone reported the smell of marijuana. My client did not want to grant police entry into her apartment without a warrant (smart girl!). She told the officer to leave and tried to shut the door. The officer claimed that she attempted to shut the door on him and then placed her under arrest for assault. The officer then claimed to get "consent" to search the apartment from my client's boyfriend (not a co-habitant - can't consent!) and found a VERY small quantity of marijuana. I appeared in court where I spoke with the officer and the municipal prosecutor and highlighted ALL of the problems with the case, including that the marijuana would likely be suppressed on a search issue and that it was highly inappropriate for the officer to essentially force his way into someone's home. Ultimately, the State agreed to dismiss ALL of the criminal charges in exchange for a guilty plea to a local ordinance (noise violation). My client paid a fine.

    Description:
    My client (a middle-aged mother) and her husband were about to begin divorce proceedings and tensions were rising in the household. After being out all night with his snowplow in a storm, my client's husband came home and a verbal altercation ensued in the kitchen, where my client was washing dishes. Words were exchanged and my client's husband left. Within moments, officers arrived at the home to place my client under arrest for Terroristic Threats. She later learned that her husband had (falsely) reported to police that she threatened to kill him with one of the knives that she was washing in the sink. He also applied for and was granted a Temporary Restraining Order ("TRO"). We first went to court for the Final Restraining Order ("FRO") hearing. After two days of testimony and a lengthy cross-examination of my client's husband, the judge found that he was not credible and dismissed the TRO. She specifically indicated that she did not believe that the alleged threat ever occurred. I later appeared to address the criminal charges. After providing the prosecutor with the evidence from the FRO hearing and fighting to ensure that she understood the underpinnings of the situation, the criminal charges were also dismissed.

    My client was facing VERY serious charges - 2nd degree Possession of a Weapon for an Unlawful Purpose, 2nd degree Unlawful Possession of a Weapon, 3rd degree Terroristic Threats, and 4th degree Aggravated Assault (pointing of a firearm) in Passaic County. The charges stemmed from a domestic violence incident that allegedly transpired between him and his girlfriend. Immediately upon being retained, I hired an investigator to work on behalf of my client. I uncovered that the "victim" had fabricated the entire incident. What's worse, she caused him to take the fall for a gun that had been turned over to him through a "no questions asked" surrender program. I presented this information to the Passaic County Prosecutor's Office who, in turn, presented it to the Grand Jury. The case was "no billed" - all charges dismissed.

    Description:
    My client (a young mother with no criminal record) was allegedly caught shoplifting at the Saks Fifth Avenue in Hackensack (Shops at Riverside). Because of the amount involved ($700), she was initially charged with a Fourth Degree indictable/felony-level offense that was sent up to the Bergen County Superior Court for handling. We successfully negotiated a remand at the County - the charges were downgraded to a disorderly persons/misdemeanor-level offense and sent back to the Hackensack Municipal Court for handling. There, we raised enough issues with the case that the State agreed to dismiss the Shoplifting charge in exchange for my client's plea to a local ordinance violation for disorderly conduct (akin to a traffic violation).

    My client (a doctor) was charged by the Newark PD with Simple Assault, a disorderly persons offense. The charge was apparently the result of a domestic violence incident between him and his ex-girlfriend in September of 2012 - it was served on him in January of 2013. The timing alone was suspect. As a good faith gesture, my client engaged in therapy to assist him in handling the emotional issues that arise in relationships. After multiple court appearances during which the State could not provide more than a bill for a local hospital visit at some point in September 2012, and taking into account my client's character, lack of criminal history, and willingness to engage in therapy, the State dismissed the charge.

    My client was arrested following an alleged domestic violence incident with her husband. When we appeared in court, I was able to demonstrate to the Municipal Prosecutor that this was nothing more than a heated marital disagreement that did not necessitate police involvement. (Interestingly, it was my client's mother-in-law, who lives in Verona and was not even present for the alleged incident, who called 9-1-1.) The Municipal Prosecutor held the charge open for a period of 30 days ("Carry Order") to ensure that there were no further incidents and then dismissed the case.

    My client was arrested and charged with Fraudulent Use of a Credit Card following an alleged incident at a store on Route 17 in Paramus. Due to the nature of the charge (indictable/felony-level), it was sent up to the Bergen County Superior Court for handling. This was most concerning for my client because of his pending immigration issues. Initially, we were able to get the case downgraded and sent back to the Paramus Municipal Court for handling. There, we were able to demonstrate to the Municipal Prosecutor that critical pieces of evidence were lacking. When the matter was listed for trial, the State could not even produce a witness from the store. Accordingly, the charge was outright dismissed.

    My client (a professor) and his wife were on the brink of a divorce when an argument ensued. It started in the house and travelled outside, where his wife stubbed her toe. She called 9-1-1 and tried to blame her "injury" on her husband, claiming that he was abusive and had thrown her to the ground. Thankfully, my client had recorded the incident on his phone - and the recording captured his wife actually attacking him. Accordingly, we were able to provide proof/evidence that the charges were unfounded. The case was dismissed by the State at our first appearance.
