Defense successfully negotiated a sentence reduction to 364 days (with time served as a result of the jail credits client had accumulated to that point) and an in-patient drug rerhab program to assist client in breaking his addiction.

    Client was charged with Possession with Intent to Distribute CDS within 1000 feet of an Elementary School. On conviction of this charge, a defendant is sentenced to State Prison with a minimum of 3 years without parole. Based on his prior record, client was eligible for sentencing to a mandatory extended term, which would have exposed him to 6 years of incarceration without parole. Based upon legal defects in the case, the defense successfully negotiated a plea to DP wandering, with fines only. (No incarceration, no probation).

Based on legal issues and argument, the charges were downgraded to DP offenses (not crimes) and then dismissed by the Court, with an agreement that Client would attend 6 sessions of Anger Management Counseling.
