Description:Client was charged with Possession with Intent to Distribute CDS within 1000 feet of an Elementary School. On conviction of this charge, a defendant is sentenced to State Prison with a minimum of 3 years without parole. Based on his prior record, client was eligible for sentencing to a mandatory extended term, which would have exposed him to 6 years of incarceration without parole. Based upon legal defects in the case, the defense successfully negotiated a plea to DP wandering, with fines only. (No incarceration, no probation).
