  • Foreign payday loan charged me with bank fraud as pmt was returned. Being served tomorrow unless I pay in full. What can I do?

Did a payday loan through CashYes in June 2012, located outside the US, then got laid off 3 weeks later, so the electronic debit was denied by my bank. They are now charging me with bank fraud unless I come up with the full amount by tomorrow at ...

    John’s Answer

I doubt that anyone will be at your home tomorrow at 2pm, besides yourself. It sounds like they are making a false threat of arrest, which is a violation of FDCPA. Yes, find an attorney specializing in collection law to help you defend this, go to a nearby legal aid center if you cannot afford one.

    John’s Answer

This is cyber-based terrorism. You should contact the FBI cyber crimes division to launch an investigation. You also should contact the adult website (there may be others too) to demand that they remove all of your information. If they do not comply, retain an attorney specializing in Internet law immediately.

  • Will an inactive warrant for non payment of fines show up on a pre-employment background check?

I got a DUI back in 2011. I did everything I was supposed to do to get the issue resolved in court and went on a payment plan for the fine. After a few payments I had forgotten about it (just out of being busy). I had no idea that a warrant had be...

    John’s Answer

Possibly not. But the more important issue is that it will always remain until you get this resolved. So even if it does not show up on this background check, it might show up on the next or the one after that. You don't want this holding you back as you try to better yourself in your career. Chances are, it will come back to haunt you eventually.

    John’s Answer

Yes, your insurance is going up. How were you able to go 81 mph on River road in Edgewater? There is so much traffic on that road as it is. Never mind, do retain a local attorney asap. This is about minimizing damages at this point.

    John’s Answer

I would agree with the other attorneys who have advised retaining a debt collection attorney in your state. They would not be able to garnish your tax refund but could levy the bank account in which the refund goes into, which is why the collector may have asked such a question. If you can prove hardship and are asking about that, then you may want to consult with a bankruptcy attorney.

  • How do I get an ex partner to lower a price on a house she is living in.

All real estate agents involved in the selling process agree that the house is grossly overpriced and circumvents solid offers.

    John’s Answer

Have her agent talk to her about this. That agent would have a vested interest in moving the house quickly. Otherwise, you can just let the market dictate that and correct her thinking. Waiting for months without a solid offer may be the best impetus for reducing the selling price on a home.

My in laws own a home, but do not have the liquidity to pay for long term care or a home health aid. We need to know the best options available. Is transferring the home to one of the kids the right option? How long is the look back period to mak...

    John’s Answer

Transferring the home to the kids may be a very good option. The look back period on Medicaid is 5 years, but this must be done carefully and preferably, with the guidance of an experienced elder care attorney. Many attorneys, myself included, offer a free consultation. It's important that you act sooner, rather than later, on this. Best of luck on the matter.
