  • AEP (CT) vs. DDP (Out-of-State)

Is the Drinking Driver Program (DDP) the same as the Alcohol Education Program (AEP)? He attended a DDP in 2007. Because a court date for conviction (jail, probation, etc.) or deciding to go to trial is coming up soon, we wonder if the names of ...

    Kevin’s Answer

I believe DDP is a NY program. So if you did the DDP as an alternative to the AEP because you had a DUI in CT but lived in NY then it is the same thing.

  • What is the statute on a bench warrant for domestic violence in connecticut in 1994

    domestic violence 1994

    Kevin’s Answer

Not sure what the question means? If you are asking if there is a limitation period the answer is no. An outstanding warrant is good until served. If you can show unreasonable delay in executing on the warrant then it is a reason to dismiss the case.

You were granted a very effective diversionary program that will result in a dismissal and a clean record. If you don't comply with the restitution order then the case will be referred back to court, AR potentially terminated and then you are facing a class B felony and bring up all the defenses you may have, but it would be a very precarious position to be in. The time to deal with the amount of the payback was before the program was granted. I doubt very much you will gain any traction trying to get the amount reduced.

  • I had a dui while teaching 3 years ago. Because it was a first offense ever I was given accelerated rehabilitation. I retired

I am now going for a part time teaching job and need a finger print and background check. Will that dui show up on my background check?

    Kevin’s Answer

It is not supposed to. That is a pretty great result getting AR for a DUI since that is not allowed but maybe they reduced the charge to something that made you eligible.. Are you sure it wasn't the Alcohol Education Program? The answer is the same but just a different program.

  • Can a police officer just begin searching me without saying anything?

    Kevin’s Answer

The police are allowed a limited intrusion for office safety. It is a very fact specific inquiry and impossible to answer a question like this on Avvo. The easy answer is "no" an office can't just go through your pockets or search you without a reason. the question will be did this officer have a legally justifiable reason for doing so.

    Kevin’s Answer

Incident when 13 should have no bearing and not even come up. If you are working with family services the usual result will be counseling and a nolle after completion which will preserve your right to apply for the Family Violence Program if you ever have another family violence incident.

    Kevin’s Answer

See the other answer I posted to what I think is the same question. Additionally, if you make bond/bail you will get a court date within two weeks. If you don't make bail or fear you won't turn yourself in early morning (7:00 AM) so you will be brought to courthouse that same day rather than being held over night. You will then go before a Judge and have the bail amount argued and you can try and get a promise to appear or minimal bond - $250 or lower.

    Kevin’s Answer

Ask the officer who you spoke with if he will call you and let you know when the warrant is in. They will not send the warrant by mail. Maybe he meant a notice that the warrant is at police department. You will need to go to PD to turn yourself in. Call before you go and ask them if there is a bond set on the warrant so you know if you can post a cash bond or need a bail bondsman. It should be very much. If they say no bond/bail was set ask him if he can ask the supervisor if there will be a bond/bail or if they will let you go with promise to appear. Then turn yourself in. If they won't give you information arrange to have bail bondsman meet you at police department.
