    Chances are your attorney is making sure all possible avenues of liability coverage are explored. It is unethical for attorneys to file lawsuits without just cause, so he isn't doing this just to squeeze money out of a party that couldn't arguably be liable in some way. That being said, the decision to sue is ultimately yours and yours alone. Talk to your attorney about why he is recommending this, and whether the possible benefits outweigh the hassle of the process, or not.

    You have a few avenues to pursue here: the first is your insurance company, if you had collision coverage, may cover the cost of the repair. If your boyfriend was a specifically excluded driver, or you didn't give him permission to drive the car, your insurance company may deny the claim.     There are literally dozens upon dozens of variables, if not more, that go into a settlement figure for injuries.     Yes, you can still recover your damages from the at fault party. If the insurance company doesn't want to pay, file a small claims suit against the lady AND the other car that actually hit you (just in case). You don't need a lawyer to file in small claims. Make sure you have your repair bill for your damages, and get a copy of the police report as well to present to the magistrate once you are in court

    There has to be some reason why your attorney would want to take so little in a wrongful death case. Sit down with him or her and have them explain all the weak points of the case and why he feels that is a good number in light of the circumstances. I assume he is working on contingency, which means the more you recover, the more he makes, so he has incentive to recover as much as possible.

    Yes, you should, if only to make sure your medical bills are paid. You will also need to prove a defect (that's the pothole) and notice, that is where a personal injury lawyer will come in handy

    The proceeds from a settlement ARE a marital asset. Just make sure your divorce attorney knows about it, that was he or she can ensure its part of the calculations.
