    Sounds like you (or the plaintiff) already have an attorney, you (or they) should discuss this decision with the attorney. Opting for a magistrate to preside over the trial isn't automatically pro-plaintiff or pro-defendant, it's merely a different person in a robe. The case will likely still be tried to a jury even if there is an agreement to have a magistrate on the bench. Good luck!

    The advice of others is spot on, she needs to apply for the public defender. Tell her to go to court nice and early on the 24th and go straight to the public defender's office when she gets in. Exactly where she stands procedurally is unclear, but the public defender should be able to figure this out quickly. Good luck!

    Contact an attorney as soon as possible, preferably (for them) before your first court date which will probably be within the next couple weeks. If you can't afford an attorney - on the morning of your first court date, go to the public defender's office and make an application for the services of the public defender. Good luck!     There are many factors to be considered before I would recommend such an assessment before a trial and you have provided no information - blanket opinions / recommendations one way or another don't do anyone any good. If you are in a position to wonder whether you should have such an assessment, you need to speak with an attorney.     It's a little unclear who (one or both of you) was arrested here, but the prior answer is spot on - speak with an attorney as soon as possible and refrain from speaking to anyone else about this.     Like many things in the law, the answer is - it depends. The first and maybe most important question is were you 17 at the time this alleged larceny occurred? If so, you might be able to be treated as a youthful offender / juvenile, versus being prosecuted as an adult. My suggestion is to talk to a local criminal defense lawyer so they can explain the process and your options to you. There are decisions you might make (if you go forward representing yourself) that could hurt you down the road....

    You indicated that you have a lawyer already - you are best served by discussing these questions with him/her as they (factually) know far more about what happened and what the other side is claiming than anyone here. Set up a meeting and sit down with your attorney to discuss! Good luck!

    I agree with what others have said. Assuming you have only been arrested one time (and successfully used the alcohol education program) you should not be disqualified for either AR or SDP. That being said, you need meet other qualifying criteria to be considered - plus, ultimately the judge must conclude that either of these programs are appropriate for you based on the particular facts of the case.
