    Unless you can show a compelling reason to the magistrate to order a new hearing you cannot have a new hearing. If there is a legitimate reason you can get a hearing on an old traffic ticket. I was able to appeal paid speeding before. It can be done if the clerk orders a new hearing.

    You can petition through the Department of Probation. Based on your facts you qualify. It should not take too long.

  • In terms of car insurance, is there a difference between a CWOF and a guilty DUI? Should i wait until its dismissed to apply?

    I read that in mass, even a CWOF adds 5 points to your record (major violation). Im buying a used car and need to update my policy where they will most likely see my CWOF. IF i wait till it is dismissed to renew my policy will they see it then?

    Yes, they will see it when your policy is up for renewal. A CWOF and a Guilty are both 5 points and insurance companies can deny coverage based on a OUI. Good Luck.

    If you are arrested for a new crime while your case is pending your previous bail can be revoked and you can be held with bail for up to sixty days without bail. If your bail is not revoked, and it is just the case of not being able to post bail you can appeal your bail to Superior. There they can either raise it, lower it, or keep it the same. If you are held on bail it will count for time but only on the case where you can't make the bail .

    I don't practice employment law however I do not believe that the owner can force you to remove your sticker. Remember the courts have called political ads speech therefore he may be violating your right to free speech.

    If it is a domestic flight I do not believe that that will be an issue. If it is international and you go thru customs you may have problem.

    If the charge was a criminal charge you will have a default warrant out for you. If it was a civil offense you would have been given the fine and lost your chance to appeal.
