    Oftentimes insurance adjusters use all means necessary to fulfill their obligations to keep claim payouts as small as possible. One method of accomplishing that is to do what the insurance company is doing in your case. If you have a lawyer, have him/her fight to convince the adjuster to accept 100% liability. Obviously, if you don't have lawyer, you are at a competitive disadvantage. Chris Earley

    No, the prior case does not get cancelled out. The second accident is a separate and distinct act unrelated to the first accident.

    Possibly. Some policies have a "medical payments" provision that means your bills related to the accident will be paid, up to a given limit.
