NOT GUILTY; 2ND OFFENSE; LICENSE RESTORED

Joseph Waldbaum

Case Conclusion Date:July 30, 2014

Practice Area:DUI / DWI

Outcome:NOT GUILTY 2ND OFFENSE

Description:"The trooper said I smelled of alcohol, had red, glassy, bloodshot eyes, and performed poorly on the field sobriety tests. Plus, he testified I didn't blow into the breath machine correctly and called it a refusal causing a three year license loss. At trial, Joe stressed to jury: it was 2:30 AM, there was no erratic driving as he followed me for one and a half miles, he said there was nothing abnormal with my fine motor skills, and he never noted that my speech was slurred in his 4 page report. Jury verdict: Not guilty."
