    It appears that you may have case, but it is very fact specific as to whether or not you do. Was the area you tripped an open and obvious hazard? The hazard could be actionable under a "mode of operation" theory in that how lowes did business gave rise to what happened to you. Not reporting the loss soon does hurt your case but I don't think it is fatal.

    There may be one or more causes of action against this woman. Negligent infliction of emotional distress and/or intentional infliction of emotional distress could be applicable here if what she is/was doing caused your son emotional distress and/or exacerbated his condition.

    First of all, as a dog person myself, I feel terrible for what you, your family, and Max have had to go through because of this person. You need to file a claim against the owner and driver of the vehicle that struck Max. It sounds like the driver that hit your dog was possibly negligent.     This sounds like a single vehicle accident, but the question is, why did you swerve? If to avoid something there may not be any liability on your part. Since you are seeking coverage through your friend's automobile insurance policy, and you were the driver, you need to cooperate with the insurer.     You can add to a statement, but keep in mind that remembering details after the statement does bring up some credibility issues. If it is the name of a witness or a doctor or a street that is one thing, but if it changes how the accident happened or who was in your car, that is something totally different.

    There are several questions that need to be answered regarding the fall. The first in my mind is how long have you lived there? Before you speak to an insurance company, you should seek advice from a personal injury attorney. The insurance adjuster will have many, many questions designed to poke holes in your story.     If this is a workers compensation case and it has been lump summed, you are supposed to receive your payment within 10 days of the settlement.

    Your boyfriend should have received notice of the clerk's hearing. The notice should state what the violation is. This is most likely a criminal matter.     Your daughter needs to retain an attorney asap regarding any criminal charges that may be coming. Regarding any civil matter, if the vehicle was insured it needs to be reported to the insurer. The insurer will provide legal representation if a legal action is commenced.
