Description: Hispanic male defendant was accused by 11 year old niece of aggravated rape on two occasions, which carries a minimum mandatory 10 year state prison sentence on each indictment. Client was released pending trial. Aggressive pursuit of discovery revealed significant inconsistencies in alleged victim's story, including a late disclosure. Individual voir dire was used to eliminate many potentially biased jurors. As a result of extensive cross examination of the victim and use of the first complaint witness, the defendant was found not guilty on all counts.
