Fantastic answer.. I love it when attorneys respond with caselaw &/or court rules/complied laws to reinforce what they are saying... it makes the 'where's waldo' search for the information so much Simpler!!!

The reason they deny jury trials is (opinion) because when a jury finds the State in the wrong and finds against the States actions the judge would have to decide against the Jury if the Judge sees it that way. Like I said before. Judges are another prosecutor sitting there in a black gown.
