I thought you only had the right to remain silent after you're in custody?

I've tried remaining silent the past two times I got stopped and the cops said I didn't have a right unless I was under arrest and when I went to go to the hospital to give a blood sample, I said I wanted my attorney present ASAP. He took my cell phone that had my attorneys' phone numbers in it from me and said my only right was the right to shut up.

Terry has given you excellent advice. I would only add two things. Follow his advice. Don't drink and drive - you seem to be pretty unlucky when you do.

it's always just a glass of wine with my meal at the olive garden. bac of .01. small town police department and new cops with lack of professionalism, experience, and ethics. the judge would not allow my bac results into my jury trial but did allow field tests at 11 pm up a hill in the rain.
