Our HOA Bylaws states: the voting rights and rights to use and enjoy the Common Area of members may be suspended during any period when assessments owed by members remain unpaid. Delinquent homeowner has not paid his HOA Dues since 2011 and filed for Chapter 13 about a week ago. The meeting of creditors is next month. Is there anything in the Bankruptcy Code that would disallow our HOA from suspending his HOA membership voting rights and the use of the laundry room and cable TV (both paid by HOA Dues) this month?
