I must respectfully disagree. Ms. Sinclair is correct that the way this issue is handled varies from district to district but then goes on to assume that the way it is handled in her district is similar to the way it is handled in most districts. It certainly differs from the way this issue is handled in NC and from what I gather from the other attorneys' posts, from the way this issue is handled in many areas. The best advice any of us can give is that due to the differences in the way this issue is handled, the answer to the question is call your attorney or if you do not have one, call a local attorney who is familiar with the practices where this case was filed.
