If the arrest is a bad arrest additional evidence that is obtained could be suppressed but it sounds as if this person was smart and asserted his right to remain silent.

If it is an illegal arrest or a bad arrest, or an arrest without probable cause, would the "fruit of poisonous tree" thing be implemented?
