Indeed, the PAGA claim is included in my court pending case and yes, I exhausted the administrative requirement before I timely filed. My question is: Should I settle this case that includes PAGA allegations, do I have to pay the state 75% out of the agreed settlement? Does the settlement for PAGA need to be approved by the court? These are my questions. EEOC settlement is agreed upon and not part of my court case.
