I personally know and have worked with and against Mr. Davis and Mr. McNamara - who answered after - for many years. I also know them both to be outstanding practitioners in this and many other areas of the law. You can trust their answers without question. Mr. Davis' thoughts about the Probate Court is something I thought about too, but I do not know enough about that area of law to have advised you about that possibility. My only concern with taking that route is that you are seeking to remove custody not from grandma, but the child's so-called father. He retains custody despite being in jail at present, and it is a tall order to remove a kid from a parent's custody via the Probate Court based upon unreported child abuse or neglect. I would contact Mr. Davis about this matter were I you, because he most assuredly knows more about the Probate forum than I.
