my daughter was going acrossed the st on her bike with her big brother and when they got to the curb a car traveling to fast struck her and pinned my daughter with her bike between the curb and her vehicle the police report isn't much help as the officer didn't put any detail to the report

What are your daughter's injuries? The driver had a legal duty not to strike your daughter if your daughter was exercising due care for her own safety while crossing the street. It is too bad the police report isn't much help, but were there any other witnesses? How old is her brother? Did the police cite the driver for a violation of some kind?
