You need to speak to a lawyer experienced with wage and hour claims. The labor comissioner offices here are so backed up that I often recommend my client's to file a lawsuit and pursue recovery that way.

Yes, but the courts are also terribly backed up. There is no good solution for plaintiffs these days; all the delays only benefit employers. The best thing we can do is vote for candidates who support workers rights and understand that our legal system has to have enough funding to survive effectively. Otherwise, the rights we have are not meaningful.

I'm sure Ms. Helvig meant to refer you to the Labor Commissioner, not the "Wage Commissioner," as there is no agency with that name. I provided the contact information for a Labor Commissioner wage claim in my response to your question.
