if he doesn't have the right to remove the fence without court order how I can prove it to the police- because police considered that he has the right to do it?
this fence had been here long before we bought the house ( about 15 years) and it can be some kind of adverse possession\easement, and we probably will go to court to get it.
but for now I just looking for the prof for the police that he doesn't have the right to remove the fence- may be there are some laws which are saying so?

It's a civil matter not a criminal matter, hence NO POLICE INVOLVEMENT.

how come that when someone is breaking another person property it's not police matter?
if it would be so any robbery would be civil matter.
