I suspect the judge misread the information on PACER. This defendant is a bankruptcy attorney and his name came up as representing clients, not as a filer. He never filed for BK.

A further question is: Why would the judge even look at the PACER system unless there was some information concerning a BK filing? Someone or something must have triggered that inquiry. And, why are you waiting until more than 1 1/2 years has passed to consider filing another action? I suspect that, if you do file, all of these issues would be raised by the defendant.
