I agree, except the lawyer doesn't have high hopes for being able to settle the debt.

So it's $5,000 to get the lawyer to roll the dice for you, and you already know the odds are poor. The settlement amount will be much more. My guess is that any highly regarded bankruptcy attorney will make that attempt effectively for less. The best argument is your commitment to file bankruptcy if settlement fails.
