I am an owner of a small process serving company called All Claims Process in the Fort Myers, FL area. I am sorry that these type of experiences occur as it impacts the reputation of all process servers. I moved my business from Wisconsin to Florida in 2010 and was shocked at the difference of the culture here in Florida. I think a solution to these issues would be for Florida to break up the local licensing authorities who all have different rules and create a state wide licensing program. Any help an attorney or other interested party could be to propose that would be great.

It is nice to know there are still legitimate process service firms in business. We have always used a small "mom and pop" company here on the East Coast who follows the law and does an honest job. As I am sure you know, the biggest firm iworks for many of the big foreclosure mills in Florida and elsewhere. The owner drives a Ferrari, and there are so many sleazy and untrue service related events that I know of I could write a book... There are a few other firms who are part of the "foreclosure industry" and also problematic.

It would take an act of the Legislature to produce the sort of licensing program you suggest. I doubt that many legislators realize how problematic process service has become regarding certain firms. If it was possible to get legislators interested in the problem, I would have no problem producing motions to quash service I have filed and the supporting affidavits that demonstrate how dishonest some of this is. Process service is a necessary function and there are lots of honest process servers. However, the big players, just like the big mortgage servicers and big foreclosure mills, have apparently decided they are above the rules.

That process server should be sued for FDCPA violations.
