That does not answer my question. So basically what you are saying that I cant play any game on my piece of land. could I walk on it or should I check that too?
Is the fact that painting lines on the ground and putting a net make it an illegal activity?

I'm not sure how how you arrived to this conclusion, but I don't believe my comment ever remotely or "basically" says that you can't play a game on your land. Let me be clear. The homeowner's association and NOT some government agency is telling you that you can't construct this tennis court. So the word "illegal" is probably not accurate. Do your due diligence and look at the CC&Rs. I answered your question. If you don't understand, you could pay an attorney $300 for a consultation.

Not really because what I am trying to find out in the first place what legally constitiute a construction. The document that I have says that the land should primarily be use to the building of houses; but not exclusively; But any construction must be for residential reason. My understanding is that if you are not planning to build for the coming years you could put a garden on your land, or plant grass to walk your dog. My intention is to play tennis on my land. I don' t intend to build anything merely flatten the ground paint some lines put a net and hit a ball. Surely this does not constitute a construction.

If your document doesn't have a definitions section to define the work "construction," then the association will have to make a pretty convincing argument to convince a judge that this constitutes construction. There is no legal definition of construction. This is where Webster comes in. Construction means the building of structures. I think you're ok. If you're still not sure, go hire a lawyer to discuss it further.

Thank you for your answer that answers my question, I also could not find any legal definition for construction. Now I have been accused of doing illegal construction can I sue for prejudice?
